This Acceptable Use Policy (“AUP”) sets out the rules and restrictions that apply to your use of the websites and services provided by Cloudsonic Hosting (“Cloudsonic”, “we”, “us”, “our”), a brand operated by Brisbane Agency (ABN: 20 039 689 628). This AUP is incorporated into and forms part of our Terms of Service.
By using our Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account without notice.

1. Prohibited Content
You must not use our Services to store, transmit, publish, or distribute any content that:
- Is unlawful, fraudulent, or facilitates any illegal activity under Australian, EU, US, or other applicable law
- Infringes any intellectual property rights, including copyright, trademark, or patent
- Is defamatory, harassing, threatening, abusive, or constitutes hate speech targeting individuals or groups on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Contains child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors
- Is pornographic or sexually explicit and not compliant with all applicable laws
- Promotes, facilitates, or glorifies violence, terrorism, or self-harm
- Contains malware, ransomware, spyware, viruses, trojans, or other malicious code
- Involves the non-consensual collection or disclosure of personal information (“doxxing”)
- Constitutes spam or unsolicited bulk communications
2. Prohibited Activities
You must not use our Services to:
- Launch, facilitate, or participate in any denial-of-service (DoS or DDoS) attacks against any person or system
- Conduct port scanning, vulnerability scanning, or network probing of systems you do not own or have explicit permission to test
- Gain or attempt to gain unauthorised access to any system, network, account, or data
- Send spam, phishing emails, or other unsolicited bulk communications
- Operate open mail relays or proxies used for abuse
- Mine cryptocurrency without the express consent of the resource owner
- Run torrenting, peer-to-peer file sharing, or seeding services in violation of applicable law or our network policies
- Circumvent or attempt to circumvent any technical measures we use to enforce this AUP or protect our infrastructure
- Resell or sublicense our Services without our prior written consent
- Engage in any activity that places excessive or unreasonable load on our infrastructure or degrades the experience of other customers
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Violate any applicable export control or sanctions laws, including those administered by Australian, US, or EU authorities
3. Email and Messaging
3.1 You must not use our Services, including any email hosting provided by Cloudsonic, to send unsolicited bulk email (spam). All commercial electronic messages must comply with the Australian Spam Act 2003, the EU General Data Protection Regulation (GDPR), and the US CAN-SPAM Act, as applicable.
3.2 You are responsible for maintaining accurate and up-to-date unsubscribe mechanisms in any commercial emails you send. You must honour unsubscribe requests promptly.
3.3 You must not forge email headers, use deceptive subject lines, or otherwise misrepresent the origin or content of any electronic communication.
4. Security Responsibilities
4.1 You are responsible for the security of your account, your Customer Content, and any applications or services you operate on our infrastructure. This includes keeping software and dependencies up to date, using strong passwords and access controls, and promptly addressing known vulnerabilities.
4.2 If you become aware of any security incident affecting your account or our infrastructure, you must notify us immediately via our contact page.
4.3 Security research and penetration testing of your own hosted infrastructure is permitted, provided it does not affect other customers or our shared infrastructure. Testing of Cloudsonic’s own systems requires prior written approval. Please refer to our Responsible Disclosure Policy for more information.
5. Resource Usage
5.1 You must use resources (CPU, RAM, storage, bandwidth) within the limits of your plan. Excessive resource usage that negatively impacts other customers may result in throttling, suspension, or a requirement to upgrade your plan.
5.2 You must not deliberately circumvent resource limits, including through the use of multiple accounts or other technical means.
6. Enforcement
6.1 We reserve the right to investigate any suspected violation of this AUP. We may, at our sole discretion and without prior notice where circumstances require it, take any of the following actions:
- Remove or disable access to content that violates this AUP
- Suspend or terminate your account
- Report activity to law enforcement or other relevant authorities
- Take legal action where appropriate
6.2 We will endeavour to provide notice of enforcement actions where reasonably practicable and where doing so does not compromise an investigation or the security of our infrastructure or other customers.
6.3 We are not obligated to monitor your use of our Services for AUP compliance, but we reserve the right to do so.
7. Reporting Violations
If you become aware of any content or activity on our Services that you believe violates this AUP, please contact us with details of the suspected violation. We take all reports seriously and will investigate appropriately.
8. Changes to This Policy
We may update this AUP from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our Services after changes are posted constitutes your acceptance of the revised AUP.
